1. Introduction

Welcome to Parking Uncover ("Platform", "we", "us", "our"). Parking Uncover is an online marketplace that connects parking space owners ("Owners") with individuals seeking parking ("Bookers"). By creating an account and using our Platform, you agree to be bound by these Terms and Conditions.

Parking Uncover acts solely as an intermediary platform facilitating transactions between Owners and Bookers. We do not own, manage, or control any parking spaces listed on the Platform.

2. Definitions

  • Owner: A registered user who lists one or more parking spaces for rent on the Platform.
  • Booker: A registered user who books and pays for parking spaces through the Platform.
  • Booking: A confirmed reservation of a parking space made through the Platform.
  • Parking Space: A parking spot or area listed by a Owner on the Platform.
  • Platform Fee: The service fee charged by Parking Uncover for facilitating transactions.

3. Account Registration

To use the Platform, you must:

  • Be at least 18 years of age.
  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Promptly update your information if it changes.
  • Accept these Terms and Conditions.

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

4. Terms for Bookers

4.1 Booking and Payment

When you book a parking space, you agree to pay the listed price plus the applicable Platform Fee. All payments are processed securely through Stripe, our third-party payment processor.

4.2 Platform Fee

Bookers are charged a Platform Fee of $0.60 AUD plus 6% of the booking amount per transaction. This fee is clearly displayed before you confirm your booking.

4.3 Your Responsibilities

  • Use the parking space only for the booked period and purpose.
  • Follow any instructions provided by the Owner for accessing and using the space.
  • Not cause damage to the parking space or surrounding property.
  • Ensure your vehicle is roadworthy and appropriately insured.
  • Vacate the parking space by the end of your booked period.

4.4 Cancellations and Refunds

Cancellation fees are calculated based on when you cancel relative to your booking start time. You will always save money by cancelling early rather than not cancelling at all.

4.4.1 Free Cancellation (Grace Period)

If you cancel within 1 hour of making a booking, and the booking was made at least 24 hours before the scheduled start time, the cancellation is free and you will receive a full refund.

4.4.2 Scaled Cancellation Fee

After the 1-hour grace period and until 24 hours before your booking start time, a cancellation fee applies. This fee increases linearly from 0% (just after the grace period) up to a maximum of 70% of the booking price (at 24 hours before start). The remaining amount is refunded.

4.4.3 Late Cancellation (Within 24 Hours of Start)

If you cancel within 24 hours of your booking start time, a flat cancellation fee of 80% of the booking price applies. You will receive a 20% refund.

4.4.4 Cancellation During an Active Booking

If you cancel after your booking has started, you are charged 100% for the time already used plus 80% of the remaining unused time. You receive a refund of 20% of the unused time remaining.

4.4.5 After Booking Ends

Once a booking has ended, no refund is available.

4.4.6 Automatic Refunds

If a booking conflict is detected after payment (for example, another user booked the same spot simultaneously), you will receive an automatic full refund.

4.5 Disputes

If you experience an issue with a parking space during or shortly after your booking, you may raise a dispute through the Platform for administrative review.

4.5.1 Dispute Window

You may raise a dispute from the booking start time up to 12 hours after the booking ends. After this window closes, disputes can no longer be raised and the booking payment will be released to the Owner.

4.5.2 Administrative Review Fee

A non-refundable Administrative Review Fee is charged to cover the cost of manual review by our team. The fee amount is displayed at the time of dispute submission and varies by region. This fee does not guarantee any specific outcome or refund.

4.5.3 Video Evidence Requirement

You must upload a video (30–60 seconds, MP4/MOV/WebM) as evidence for your dispute. The video must show your face at the start, be recorded in one continuous take without cuts or edits, clearly show the parking spot and the issue, and include a verbal explanation.

Video evidence must be submitted before the dispute window closes (12 hours after booking end). If valid evidence is not provided, the dispute will be rejected and the review fee will not be refunded.

4.5.4 Review and Outcome

Our team will review the dispute, the evidence provided, and the booking details. Possible outcomes include a full refund, partial refund, or no refund of the booking payment. The Administrative Review Fee may be refunded at our discretion. All decisions are final.

4.5.5 Security Deposit

If a parking space requires a security deposit, the deposit must be paid before access instructions are provided and before a dispute can be raised.

Security deposit handling: For short bookings, the security deposit is usually placed as a temporary hold and released automatically after the booking ends at no cost. For longer bookings, a temporary hold may not be supported by the payment method. In these cases, the security deposit may need to be charged and later refunded, which incurs a small non-refundable processing cost.

Processing fees on claims: If a security deposit is claimed, standard payment processing fees apply and are deducted from the claimed amount before payout. These fees are set by payment providers and are not controlled by ParkingUncover.

5. Terms for Owners

5.1 Listing Your Parking Space

As a Owner, you may list parking spaces for rent on the Platform. You represent and warrant that:

  • You have the legal right to rent the parking space.
  • Your listing information is accurate, complete, and up to date.
  • The parking space is safe, accessible, and suitable for parking vehicles.
  • You comply with all applicable local laws, regulations, body corporate rules, and council requirements related to renting parking spaces.

5.2 Stripe Connect and Payouts

To receive payouts, Owners must complete the Stripe Connect onboarding process. Stripe Connect is a payment platform that enables us to route payments directly to your account. By onboarding with Stripe Connect, you also agree to Stripe's Connected Account Agreement.

5.3 Owner Payouts

Owners receive the booking amount minus the Platform Fee. For example, on a $100 booking, the Owner receives $93.40 (the booking amount minus $0.60 + 6% Platform Fee). Payouts are processed through Stripe to your connected bank account.

5.4 Owner Responsibilities

  • Maintain accurate availability for your parking space.
  • Provide clear access instructions for Bookers.
  • Ensure the parking space is available and accessible during booked periods.
  • Respond to booking-related enquiries in a timely manner.
  • Maintain appropriate insurance for your property.

6. Payments and Fees

All payments are processed through Stripe, a PCI-compliant payment processor. We do not store your credit card information on our servers.

Fee breakdown per transaction:

  • Platform Fee (charged to Booker): $0.60 AUD plus 6% of the booking amount.
  • Owner Payout: Booking amount minus the Platform Fee.

All prices on the Platform are displayed in Australian Dollars (AUD) unless otherwise stated.

7. Prohibited Conduct

All users agree not to:

  • Provide false, misleading, or inaccurate information.
  • Use the Platform for any unlawful purpose.
  • Circumvent the Platform's payment system to avoid fees.
  • Harass, threaten, or abuse other users.
  • Interfere with the Platform's operation or security.
  • Create multiple accounts for fraudulent purposes.
  • List parking spaces you do not have the right to rent.

We reserve the right to suspend or terminate accounts that violate these terms.

8. Limitation of Liability

Parking Uncover operates as an intermediary marketplace. To the maximum extent permitted by law:

  • We are not responsible for the condition, legality, or suitability of any parking space.
  • We are not liable for any damage to vehicles, property, or persons arising from the use of a parking space.
  • We do not guarantee the availability of any parking space.
  • We are not responsible for disputes between Owners and Bookers, although we will make reasonable efforts to assist in resolution.

Our total liability to you for any claim arising out of your use of the Platform is limited to the amount of fees you have paid to us in the 12 months preceding the claim.

9. Privacy

Your privacy is important to us. We collect and use your personal information in accordance with applicable privacy laws, including the Australian Privacy Act 1988. Information we collect includes your name, email address, phone number, and payment details (processed securely by Stripe).

We do not sell your personal information to third parties. We only share information as necessary to facilitate bookings (e.g., sharing Owner access instructions with confirmed Bookers).

10. Modifications to Terms

We may update these Terms and Conditions from time to time. We will notify registered users of material changes via email or through the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated terms.

11. Governing Law

These Terms and Conditions are governed by the laws of Australia. Any disputes arising from these terms or your use of the Platform will be subject to the jurisdiction of the courts of Australia.
